1. 적용

이 약관은 마인드봄주식회사(이하 "회사")이 제공하는 모바일 앱 토키와 그에 딸린 서비스(이하 "서비스")를 이용하는 모든 분(이하 "이용자")에게 적용됩니다. 앱을 설치하고 사용하면 이 약관에 동의한 것으로 봅니다. 동의하지 않으면 사용을 중단하고 앱을 삭제해 주세요.

개인정보의 처리는 별도의 개인정보처리방침을 따릅니다.

2. 서비스의 내용

  • AI와의 자유 대화·역할극·전화 모드, 발음 교정, 섀도잉, 파닉스, 단어·문장 복습 등 외국어 말하기 연습 기능
  • 학습 기록의 기기 저장과, 로그인 시 클라우드 백업·복원

서비스의 일부는 외부 AI·음성 인식·음성 합성 제공자를 통해 동작합니다(제공자 목록은 개인정보처리방침 2조). 회사는 서비스의 내용을 개선하거나 변경할 수 있으며, 중요한 변경은 앱 또는 스토어 페이지에서 알립니다.

3. 계정

  • 서비스는 로그인 없이 이용할 수 있습니다. 로그인(Apple·카카오·구글)은 선택이며, 기기를 바꿔도 학습 기록을 이어가기 위한 것입니다.
  • 이용자는 본인의 계정과 기기의 접근을 안전하게 관리할 책임이 있습니다.
  • 이용자는 앱 안에서 언제든 계정을 삭제할 수 있습니다. 삭제하면 서버의 계정 정보와 클라우드 백업이 삭제되고, 이 기기의 학습 기록도 지워집니다. 자세한 범위는 개인정보처리방침 4조에 있습니다. 결제 기록은 관련 법령(전자상거래법)에 따라 정해진 기간 보관됩니다.

4. 무료 이용과 토키+

  • 서비스의 기본 기능은 무료입니다. 무료 이용에는 하루 단위의 사용량 제한(예: AI 대화 턴 수)이 있으며, 제한은 앱 안에서 안내됩니다.
  • 토키+는 유료 구독(toki_plus_monthly 월간, toki_plus_yearly 연간) 또는 일회 결제 (toki_plus_lifetime 평생 이용권)로 제공됩니다. 가격은 결제 화면과 스토어에 표시된 금액을 따르며, 국가·통화·세금에 따라 다를 수 있습니다.
  • 구독은 해지하지 않으면 각 기간이 끝날 때 자동으로 갱신되고, 갱신 최소 24시간 전에 스토어 계정 설정에서 해지할 수 있습니다. 해지해도 이미 결제한 기간이 끝날 때까지는 이용할 수 있습니다.
  • 결제·영수증·환불은 Apple App Store 또는 Google Play가 처리합니다. 청약철회와 환불의 자세한 조건은 환불 및 청약철회 정책에 있으며, 이 약관의 일부입니다.
  • 회사는 요금과 상품 구성을 바꿀 수 있습니다. 변경은 다음 갱신부터 적용되며, 이미 결제한 기간에는 영향을 주지 않습니다.

5. AI가 만든 콘텐츠

  • 대화 상대의 답변, 문장 교정, 번역, 발음 점수와 피드백은 인공지능이 생성합니다. 정확하지 않거나 부적절할 수 있습니다. 회사는 그 정확성·완전성을 보증하지 않습니다.
  • 이런 콘텐츠는 언어 연습을 돕기 위한 것입니다. 시험 답안, 공식 번역, 계약·법률·의료·재무 등 결과가 중요한 판단의 근거로 사용하지 마세요.
  • 이용자가 입력한 문장과 음성은 답변을 만들기 위해 외부 제공자에게 전달되고, 처리 후 폐기됩니다. 자세한 내용은 개인정보처리방침에 있습니다.

6. 이용자의 의무

다음 행위는 금지됩니다.

  • 법령이나 공서양속에 어긋나는 내용, 타인을 괴롭히거나 차별·혐오하는 내용의 입력·생성
  • 서비스나 서버에 비정상적인 부하를 주는 행위, 사용량 제한을 우회하려는 행위, 자동화된 대량 요청
  • 서비스를 역설계·복제·재판매하거나, 회사 또는 제3자의 지식재산권을 침해하는 행위
  • 타인의 계정을 무단으로 사용하는 행위

위반이 확인되면 회사는 해당 이용을 제한하거나 계정을 정지할 수 있습니다.

7. 지식재산권

서비스와 그 안의 콘텐츠(디자인, 캐릭터, 문구, 소프트웨어)의 권리는 회사 또는 정당한 권리자에게 있습니다. 이용자가 입력한 문장과 음성, 그리고 이용자가 저장한 학습 기록은 이용자의 것입니다. 회사는 서비스를 제공하는 데 필요한 범위에서만 이를 처리합니다.

8. 서비스의 변경·중단

  • 회사는 점검, 장애, 외부 제공자의 사정, 사업상 필요에 따라 서비스의 전부 또는 일부를 변경하거나 일시 중단할 수 있습니다. 가능하면 사전에 알립니다.
  • 서비스를 종료할 때는 상당한 기간을 두고 앱 또는 스토어 페이지에서 알리고, 이미 결제한 기간이 남은 이용자에게는 관련 법령과 스토어 정책에 따라 처리합니다.

9. 책임의 제한

  • 서비스는 "있는 그대로" 제공됩니다. 회사는 서비스가 언제나 중단 없이, 오류 없이 동작한다고 보증하지 않습니다.
  • 회사는 이용자가 AI 생성 콘텐츠를 신뢰해 내린 판단, 외부 제공자의 장애, 기기·통신 환경으로 인한 손해에 대해 관련 법령이 허용하는 범위에서 책임을 지지 않습니다.
  • 회사의 고의 또는 중대한 과실로 인한 손해에 대해서는 이 조항이 책임을 제한하지 않습니다.
  • 소비자보호 관련 법령상 이용자의 권리는 이 약관으로 제한되지 않습니다.

10. 미성년자

만 14세 미만은 서비스를 이용할 수 없습니다. 미성년자의 유료 결제에는 법정대리인의 동의가 필요하며, 동의 없는 결제는 관련 법령에 따라 취소될 수 있습니다(환불 정책 5조).

11. 약관의 변경

회사는 이 약관을 변경할 수 있습니다. 변경 시 시행일 최소 7일 전(이용자에게 불리한 변경은 30일 전)에 앱 또는 이 페이지에서 알립니다. 변경 후에도 서비스를 계속 이용하면 변경된 약관에 동의한 것으로 봅니다.

12. 준거법과 분쟁

이 약관은 대한민국 법률을 따릅니다. 서비스 이용과 관련한 분쟁은 먼저 mindbom0821@gmail.com로 알려 주시면 성실히 협의하고, 해결되지 않으면 민사소송법상 관할 법원에서 다룹니다. 소비자는 한국소비자원 등 관련 기관에 피해구제를 신청할 수 있습니다.

  • Toki is an app for practicing a foreign language by talking with an AI. Sign-in is optional and exists to back up your learning across devices.

1. Scope

These terms apply to everyone who uses the Toki mobile app and related services (the "Service") provided by MINDBOM Inc. (the "Company"). By installing and using the app you agree to these terms; if you don't, stop using the app and delete it. Personal data is governed separately by the Privacy Policy.

2. The Service

Free-talk, role-play and call modes with an AI, pronunciation coaching, shadowing, phonics, vocabulary and sentence review; local storage of your learning history and, when signed in, cloud backup and restore. Parts of the Service run on third-party AI, speech-recognition and speech-synthesis providers (listed in the Privacy Policy). We may change or improve the Service; material changes will be announced in the app or on the store page.

3. Accounts

Sign-in (Apple, Kakao, Google) is optional and exists to carry your history across devices. You are responsible for keeping access to your account and device secure. You can delete your account anytime in the app; this removes your server-side account and cloud backup and clears this device's learning history (see Privacy Policy §4). Payment records are retained for the period required by law.

4. Free use and Toki+

The core features are free with daily usage limits (e.g. AI conversation turns) shown in the app. Toki+ is offered as a subscription (toki_plus_monthly, toki_plus_yearly) or a one-time purchase (toki_plus_lifetime) at the price shown at checkout, which may vary by country, currency and tax. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period via your store account settings; after cancelling you keep access until the paid period ends. Purchases, receipts and refunds are handled by Apple or Google. Withdrawal and refund conditions are in the Refund & Withdrawal Policy, which forms part of these terms. We may change prices or plans; changes apply from the next renewal and never to a period already paid.

5. AI-generated content

Replies, corrections, translations, pronunciation scores and feedback are generated by AI and may be inaccurate or inappropriate; we do not warrant their accuracy or completeness. They are meant to help you practice — do not use them as the basis for exams, official translations, or legal, medical or financial decisions. Text and audio you enter are sent to third-party providers to produce a reply and discarded after processing (see Privacy Policy).

6. Your obligations

You must not: enter or generate unlawful, harassing, discriminatory or hateful content; place abnormal load on the Service, circumvent usage limits, or send automated bulk requests; reverse-engineer, copy or resell the Service or infringe the Company's or third parties' intellectual property; use another person's account without permission. We may restrict use or suspend accounts for violations.

7. Intellectual property

The Service and its content (design, characters, copy, software) belong to the Company or its licensors. What you type or say, and the learning history you save, is yours; we process it only as needed to provide the Service.

8. Changes and interruptions

We may change or temporarily suspend all or part of the Service for maintenance, outages, third-party provider issues or business reasons, with advance notice where possible. If we discontinue the Service we will give reasonable notice in the app or on the store page and handle remaining paid periods in accordance with applicable law and store policy.

9. Limitation of liability

The Service is provided "as is". We do not warrant uninterrupted or error-free operation. To the extent permitted by law we are not liable for losses arising from reliance on AI-generated content, third-party provider failures, or your device or network. Nothing here limits liability for our intent or gross negligence, or your statutory consumer rights.

10. Minors

The Service is not available to children under 14. Paid purchases by minors require a legal guardian's consent; purchases made without it may be cancelled under applicable law (Refund Policy §5).

11. Changes to these terms

We may amend these terms with at least 7 days' notice (30 days for changes unfavorable to you) in the app or on this page. Continued use after the effective date constitutes acceptance.

12. Governing law and disputes

These terms are governed by the laws of the Republic of Korea. Please contact mindbom0821@gmail.com first so we can try to resolve any dispute in good faith; otherwise the competent court under the Korean Civil Procedure Act applies. Consumers may also seek redress from the Korea Consumer Agency or similar bodies.
